On September 14, 2026 Profusion filed nearly identical motions to compel both entities to produce documents and appear for deposition, and to hold them in contempt, impose sanctions, and award fees under NRCP 45 and 37. The court issued orders to show cause requiring Empire and M3 to appear September 29, 2026 at 9:30 a.m. and explain why they should not be held in contempt for failing to obey the subpoenas. Notices of hearing set the underlying motions to compel for October 20, 2026 at 9:30 a.m. in Courtroom 12C at the Regional Justice Center. An affidavit of service confirms the Empire show-cause packet was personally served on registered agent Casey Weseloh on September 17, 2026.
